1. Binding Agreement
By entering Witch's Garden at aerovandrelix.site (“the Site”), you enter into a binding agreement with the operators of this enchanted plot. These Terms of Service (“Terms”) set forth the rules of the garden. If any clause offends your sensibilities, kindly refrain from sowing seeds here.
2. Nature of the Service
Witch's Garden is an interactive, browser-based experience intended for amusement and creative expression. All botanical elements, visual effects, and incantations are provided free of charge. We reserve the right to prune, replant, or restructure the garden at our sole discretion, without prior warning.
3. Who May Tend the Garden
You must be at least 13 years of age to use the Site independently. Visitors below that threshold are welcome only under the watchful eye of a parent or legal guardian. By continuing, you affirm that you satisfy this requirement.
4. Forbidden Practices
The following conduct is strictly prohibited within the garden walls:
- Employing scripts, bots, or automated tools to artificially inflate herb counts or manipulate the planting mechanism;
- Reverse-engineering, decompiling, or extracting source code for redistribution;
- Transmitting malicious software, worms, or any code designed to disrupt the Site or its visitors;
- Using the Site for commercial solicitation, pyramid schemes, or unsolicited messaging;
- Impersonating another sorcerer, gardener, or entity.
5. Ownership of the Harvest
All artwork, typography, animations, soundscapes, and underlying code within Witch's Garden are the exclusive property of the Site operator or its licensors, shielded by international copyright and trademark law. You are granted a personal, revocable, non-transferable license to interact with the garden for non-commercial purposes. No seeds, stems, or sprites may be harvested for external use without express written consent.
6. No Warranty of Fertility
The Site is furnished “as is” and “as available.” We make no representation that the soil will always be rich, the stars will always twinkle, or the garden will be free of bugs—digital or otherwise. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the operators of Witch's Garden shall bear no liability for indirect, incidental, consequential, or punitive damages arising from your use of—or inability to use—the Site, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to defend, indemnify, and hold harmless the Site operator, its affiliates, and their respective stewards from any claim, damage, or expense arising out of your breach of these Terms or your misuse of the garden.
9. Governing Law & Jurisdiction
These Terms shall be interpreted and enforced in accordance with the laws of the jurisdiction in which the Site operator resides, without giving effect to any choice-of-law principles that would lead to the application of another jurisdiction's laws.
10. Severability
Should any provision of these Terms be deemed unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, much like a well-rooted perennial surviving a single harsh frost.
11. Modifications
We may amend these Terms as the seasons change. Notice of material revisions will be posted on this page, and the “Last updated” date will be refreshed. Your continued cultivation within the garden after such changes constitutes acceptance of the revised Terms.
